MyPropInsight — Terms and Conditions
(Application, Platform, Dashboard, Website)

1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern access to and use of the MyPropInsight mobile application, web platform, dashboards, APIs, and associated services (collectively, the "Platform").
The Platform is owned and operated by MyPropInsight (Pty) Ltd (Registration No. 2011/007952/07), a private company incorporated in the Republic of South Africa ("MyPropInsight", "the Company", "we", "us", or "our").
By accessing, registering on, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any incorporated policies, addenda, or notices.
If you do not agree, you must not use the Platform.

Any additional notices, policies, or disclosures published on the Platform

In the event of a conflict, these Terms shall prevail unless expressly stated otherwise. Links to the above documents are made available on the MyPropInsight website, application, and dashboard.

2. Platform Purpose and Limitation of Role
MyPropInsight is a property intelligence platform for South African homeowners. It provides information, tools, calculators, record-keeping, and workflow features relating to residential property ownership, and facilitates introductions to independent, appropriately licensed service providers.

MyPropInsight is not, and does not act as:
> An estate agent or property practitioner marketing property on your behalf.
> A registered professional valuer or professional associated valuer in terms of the Property Valuers Profession Act, 2000.
> A financial services provider (FSP) or financial adviser in terms of the Financial Advisory and Intermediary Services Act, 2002 (FAIS)
> A credit provider in terms of the National Credit Act, 2005
> An attorney, conveyancer, tax practitioner, or fiduciary

MyPropInsight does not:
> Provide legal, financial, tax, valuation, or transactional advice
Guarantee outcomes, prices, approvals, savings, or transactions
> All decisions, negotiations, applications, and transactions remain solely between you and the relevant counterparties or licensed providers.

3. Opinions of Value and Informational Outputs
The Platform may generate an Opinion of Value and related property intelligence outputs (including municipal value comparisons, equity indications, cost illustrations, and scenario calculators).

You acknowledge and agree that:
> An Opinion of Value is an informational estimate produced by data-driven models. It is not a valuation or appraisal performed by a registered professional valuer, and may not be relied upon as such — including for lending, insurance, expropriation, litigation, or regulatory purposes.
Outputs are provided with confidence indicators where available, and the Platform may decline to display a figure where data is insufficient.
> All financial figures shown on the Platform are illustrative unless expressly stated to be sourced from verified records.
> Property data (including deeds, municipal, and market data) is obtained from third-party sources and public records, and may contain errors, omissions, or delays. MyPropInsight does not warrant the accuracy, completeness, or currency of such data.

4. User Categories and Access Tiers
The Platform supports multiple user roles, including but not limited to:
> Homeowners
> Property professionals and licensed service providers
> Corporate, enterprise, or administrative users

Access levels, features, and pricing vary by role and subscription tier. Where your account originates through one of our distribution partners, certain features and service-provider routing may be determined by the terms of that partnership (see Section 9).

MyPropInsight reserves the right to modify role permissions and tier structures on reasonable notice.

5. Account Registration and Security
Users must:
> Provide accurate, complete, and current information
> Maintain the confidentiality of credentials
> Restrict access to authorised users only

You are responsible for all activity conducted under your account. MyPropInsight is not liable for losses arising from compromised credentials, user negligence, or unauthorised access, except to the extent such liability cannot be excluded under applicable law.

Identity Verification
Certain features (including deed-linked ownership verification) require identity verification through third-party verification services. You warrant that information submitted for verification is your own and is accurate. South African identity numbers submitted for verification are processed securely and are not stored in plain form. Verification outcomes are informational and do not constitute a guarantee by MyPropInsight.

6. Subscriptions, Fees, and Billing
Certain Platform features, access tiers, and services require a paid subscription or service fee.
Subscriptions are billed in advance at the stated interval unless otherwise agreed in writing.
Payment is processed through the Platform's authorised payment providers
Access rights are provisioned server-side and reflected across the Platform upon confirmed payment
MyPropInsight reserves the right to modify pricing, tiers, or features on reasonable prior notice; changes will not apply retrospectively to a billing period already paid

Refunds and cancellations are handled in accordance with the Consumer Protection Act, 2008 and, where applicable, the cooling-off provisions of the Electronic Communications and Transactions Act, 2002. Nothing in these Terms limits any right to a refund you have under applicable law.

Failure to settle fees when due may result in restricted access, suspension, or termination.

7. User Content and Representations
Users are solely responsible for content they submit, including:
> Property details, descriptions, photographs, and documents
> Data entered into calculators, trackers, and records
> Communications conducted via the Platform

By submitting content, you warrant that you are entitled to do so and that it does not infringe any third-party rights. You grant MyPropInsight a non-exclusive licence to host, process, and display such content for the purpose of operating and improving the Platform, subject to the Privacy Policy.

MyPropInsight does not verify, validate, or warrant user-provided content unless explicitly stated. False, misleading, or unlawful content may result in immediate suspension or termination.

8. Third-Party Services and Data Providers
The Platform may integrate third-party services, including identity verification, deeds and property data, payment processing, and communications services ("Third-Party Services").

You acknowledge that:
Third-Party Services operate independently under their own terms
Verification and data results do not constitute guarantees and do not replace your own due diligence
Service failures, delays, or inaccuracies may occur, and no liability attaches to MyPropInsight for reliance on Third-Party Service outputs, except to the extent such liability cannot be excluded under applicable law

9. Referrals to Licensed Providers
The Platform may facilitate introductions to independent, appropriately licensed providers of bond origination, insurance, legal, and related services.

MyPropInsight facilitates introductions only. Any advice, quotation, product, or credit agreement is provided by the licensed provider under its own licence and terms.
Where your account is attributed to a distribution partner, referrals for certain services are routed to designated partner providers in accordance with our contractual arrangements.
Where MyPropInsight receives a fee or other benefit in connection with a referral, this will be disclosed as required by applicable law.

10. Intellectual Property
All intellectual property rights in the Platform — including software, code, designs, workflows, models, data compilations, trademarks, and branding — remain the exclusive property of MyPropInsight (Pty) Ltd and/or its licensors.

No rights are granted except those expressly stated. Reverse engineering, scraping, automated data extraction, copying, or unauthorised use of the Platform or its data is strictly prohibited.

11. Prohibited Conduct
Users may not:
> Circumvent Platform workflows, entitlements, or safeguards
> Misrepresent identity, authority, ownership, or property details
> Use the Platform for unlawful, deceptive, or abusive purposes
> Interfere with system integrity or security
> Scrape, harvest, or extract data or user information without written permission
> Use Platform outputs to provide regulated services (including valuations or financial advice) to third parties without the required licence

Violations may result in immediate termination and legal action.

12. Data Protection and Privacy
Personal information is processed in accordance with:

> The Protection of Personal Information Act, 2013 (POPIA)
> Other applicable data protection laws

By using the Platform, you acknowledge that you have reviewed the Privacy Policy, including the use of authorised operators (sub-processors) and third-party data sources. Consent for communications is specific to each channel and may be withdrawn at any time.

13. Suspension and Termination
MyPropInsight may suspend or terminate access:
> For breach of these Terms
> For misuse, fraud, or risk exposure
> For legal or regulatory reasons
> To protect Platform integrity or other users

Termination does not affect accrued rights or obligations. You may close your account at any time; deletion of personal information following closure is handled per the Privacy Policy.

14. Disclaimer of Warranties
The Platform is provided "as is" and "as available". To the extent permitted by law, MyPropInsight disclaims all warranties, express or implied, including merchantability, fitness for purpose, accuracy, availability, and non-infringement.

Nothing in these Terms excludes or limits any warranty or right that cannot be excluded under the Consumer Protection Act, 2008 or other applicable law.

15. Limitation of Liability
To the maximum extent permitted by law:
> MyPropInsight is not liable for indirect, incidental, special, or consequential damages, including loss of profit, opportunity, data, reputation, or transactions
> MyPropInsight is not liable for decisions made in reliance on Opinions of > Value or other informational outputs
> Aggregate liability is limited to fees paid by you in the preceding three (3) months

Nothing in these Terms excludes liability for gross negligence, fraud, or any liability that cannot lawfully be excluded.

16. Indemnification
You agree to indemnify and hold harmless MyPropInsight, its directors, employees, and partners from claims arising from:
> Platform misuse
> False representations
> Breaches of law or these Terms
> Third-party disputes arising from your conduct

17. Force Majeure
MyPropInsight is not liable for failure or delay due to events beyond reasonable control, including infrastructure outages, regulatory actions, cyber incidents, acts of God, and third-party failures.

18. Changes to Terms
MyPropInsight may update these Terms from time to time. Material changes will be notified via the Platform or by email with reasonable prior notice. Continued use after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you must stop using the Platform and may cancel any subscription in accordance with Section 6.

19. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved in the competent South African courts, without prejudice to your right to refer a matter to the National Consumer Commission, the Information Regulator, or any other forum available under applicable law.

20. Entire Agreement
These Terms, together with the incorporated policies and addenda, constitute the entire agreement governing use of the Platform and supersede all prior agreements or understandings relating to its subject matter.

Electronic communications sent to the above addresses shall be deemed received on the date of transmission.

Electronic Communications

You consent to receive communications, notices, disclosures, and agreements electronically, including via the Platform, email, or dashboard notifications. Such communications satisfy any legal requirement that communications be in writing, in accordance with the Electronic Communications and Transactions Act, 2002.
